LeaveWizard Service

All the services on the website are solely provided by LeaveWizard. This service aims to be available online 24 hours a day, 7 days a week however LeaveWizard reserves the right to stop the service for maintenance or upgrades. In such cases LeaveWizard will make every attempt to provide reasonable notice and if possible carry out the work during scheduled maintenance hours. Access to our site is permitted on a temporary basis. We may suspend, withdraw, discontinue or change all or any part of our site without notice. LeaveWizard reserves the right (without any obligation) to inspect the content of material transmitted by you through the Service to make sure that it complies with our Terms and Conditions or any applicable laws. If we find material that does not comply we reserve the right to suspend or terminate this Agreement. You are also responsible for ensuring that all persons who access our site through your internet connection are aware of these terms of use and other applicable terms and conditions, and that they comply with them.

Intellectual Property

All intellectual property rights in the LeaveWizard website including without any limitation all the html and other scripts, the design and layout as well as graphics, the information content and any software made available by LeaveWizard to enable the User to use the Service shall remain the property of LeaveWizard. LeaveWizard grants the User a non-exclusive non-transferable licence to use such software solely in connection with and to the extent necessary for use of the Service and for no other purpose. The User shall not decompile, reverse engineer or modify the software referred to above in any way except as is expressly provided in Section 50B of the Copyright Design and Patent Act 1988.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

In no event will LeaveWizard be liable for any indirect or consequential loss or damage of any kind however caused and whether arising under contract, crime or otherwise. The User agrees to assure LeaveWizard against any claims brought by a third party resulting from the User’s use of the Service and in respect of any losses or liabilities incurred directly by LeaveWizard as a result of the User’s breach or non-observance of any of these terms and conditions. The User shall pay all costs, damages, awards, fees (including any reasonable legal fees) and judgements awarded against LeaveWizard arising from any such claims and shall provide LeaveWizard with notice of such claims, full authority to defend, compromise or settle such claims and reasonable assistance necessary to defend such claims, at the Users sole expense. The provisions of this section shall survive any termination of this agreement.

Nothing in these terms of use excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

We will not be liable for any loss or damage caused by a virus, distributed denial-of-service attack, or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our site or to your downloading of any content on it, or on any website linked to it.

We assume no responsibility for the content of websites linked on our site. Such links should not be interpreted as endorsement by us of those linked websites. We will not be liable for any loss or damage that may arise from your use of them.

Your Account and Password

You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction. However, if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms of use, its subject matter and its formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
